Terms of Use
Cool Parent Certified ("the service") is operated by Alpine Lake Systems LLC ("we", "us", "our"). These Terms of Use ("Terms") are a binding agreement between you and us. By signing in or otherwise using the service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service.
1. Eligibility
You must be at least 18 years old and a parent or legal guardian to use the service. By using it you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Your account
You sign in with a Google account and choose a public handle. You are responsible for keeping your Google account secure and for all activity through your sign-in. Your handle is visible to other users and must not impersonate anyone or be offensive, infringing, or misleading; we may reclaim or change handles that violate this.
3. Certification is self-attested — not verified by us
This is the most important thing to understand about the service. "Certification" means only that you have attested to the items in the Cool Parent pledge. We do not verify, inspect, monitor, or guarantee that any user — including you — actually meets the pledge, maintains any safeguard, or supervises any child as described. A "Certified" badge is one parent's self-declaration, nothing more.
You must not rely on another user's certified status as assurance that their home, devices, or supervision are safe for your child. Decisions about your child's safety — including whether to let your child visit, stay with, or use devices at another household — remain entirely your own, and you assume all risk associated with them. The service is an accountability and social tool, not a safety certification, background check, or endorsement.
4. Record of your attestation
When you certify, we record your attestation: the version of the pledge, the items you attested to, the date and time (as captured by your browser and by our server), and the IP address and browser user-agent on that request. You consent to our creating and retaining this record, and you agree it constitutes evidence of your attestation. You agree that every attestation you submit is true and made in good faith.
5. Friends and visibility
Adding another user by handle lets you see their handle, display name, and certified status. Other users can likewise add you and see yours. Do not add a handle expecting privacy in your certified status — it is designed to be shared with the parents you connect with.
6. Acceptable use
You agree not to, and not to attempt to:
- submit a false or bad-faith attestation, or misrepresent who you are;
- use the service to break the law or to harass, defame, or harm anyone;
- access another user's account or data, or any system, without authorization;
- probe, scan, overload, disrupt, or interfere with the service or its infrastructure;
- scrape the service or its users' data, or build a competing product from it except as permitted by law; or
- remove or obscure any notice in the service.
We may investigate, and may suspend or terminate accounts, for conduct we reasonably believe violates these Terms or harms the service or other users.
7. Intellectual property
The service — its software, design, the pledge text, and branding — belongs to us or our licensors and is protected by law. These Terms grant you a personal, non-exclusive, non-transferable, revocable license to use the service as offered; they grant you no other rights.
8. Termination
You may stop using the service at any time. We may suspend or terminate your access at any time, with or without notice, including if we discontinue the service or believe these Terms have been violated. Sections that by their nature should survive termination — including Sections 3, 4, 9, 10, 11, and 12 — survive.
9. Disclaimer of warranties
The service is provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from the certified status of any user. We do not warrant that the service will be uninterrupted, secure, error-free, or that data will not be lost. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
To the maximum extent permitted by law, Alpine Lake Systems LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, or for any harm arising from your or anyone's reliance on a user's certified status, arising out of or relating to your use of (or inability to use) the service, even if advised of the possibility. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the service will not exceed one hundred U.S. dollars (US$100). These limits apply regardless of the legal theory and are a fundamental basis of the bargain between you and us.
11. Indemnification
You agree to indemnify, defend, and hold harmless Alpine Lake Systems LLC and its owners, employees, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to your attestations, your use of the service, or your violation of these Terms or of any law or third-party right.
12. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Delaware have exclusive jurisdiction over any dispute not otherwise resolved, and you consent to venue there. Nothing here limits any non-waivable rights you have under the mandatory law of your place of residence.
13. Changes to these Terms
We may update these Terms. When we make a material change we will revise the version and effective date above, and we may require you to review and re-attest before continuing to use the service. Otherwise, continued use after a change takes effect is your acceptance of it.
14. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
